Present particular conditions (from now PC) have the objective to define terms and conditions of the existent relationship between various parts, or rather beneficiaries, guests and other users that use the service of Gift list or gift list of Ceramica Vietrese. These PC complete the General conditions present on the e-commerce website and are available to consult in every moment on www.ceramicavietrese.it
Signing the Activation contract of Gift list or Ceramica Vietrese Gift List, user declare to know completely the conditions of the present Contract and to approve them in every part. If there is not the acceptance of these conditions the use of Ceramica Vietrese service will not be possible.

Definitions
Beneficiary: are the physical people who take advantage of the service of the website and of the Ceramica Vietrese Gift List.
Guests: all the people who visit the website or the gift list, after the publications of these by the beneficiaries.
Users: all the people that visit the website.
Contributor: all the guests that bought a gift from the gift list.
Contribution: when a guest pay a participation to the gift list.
Transaction: operation of payment effectuated through Ceramica Vietrese.

DESCRIPTION oF THE SERVICE LIST ONLINE
3.1 General description
Service offered by the website www.ceramicavietrese.it are:
1. A system to create online a page dedicated and a “gift list” where insert your gift ideas CHOOSEN AMONG THE PRODUCTS. (Basic Version)
2. A platform to organize and personalize a website dedicated to your EVENT making easy the access to this page for every people (from now GUEST) that the User prefer, allowing them to
buy something from your GIFT list published on the website. (Premium Version)
3.2 CREATIONS OF A LIST ONLINE

The creations of a list it will be given automatically the Basic Version free and the Template Basic. If you aren’t register on the website it occur to do it filling in the form. After the registration, you can create your list and choose the products. User could organize the products of his list choosing the product to include. If you want, you can specify the quote number for every product, so the guest which would give a determinate product could purchase one or more quotes as alternative to complete product.

Subsequently, If you want, it will be possible buy PREMIUM version and pass to another subscription and a Template Premium. Purchase of Premium version will pass from the shopping cart of the website and it will follow the flows of the sales and payment on the website. Ceramica Vietrese with Premium version, permit to the users to add a real website to the Gift List. For the creation of the List, Ceramica Vietrese permit to the Users to see a catalogue where select all the product contain in the e-commerce website; all the products are completely changeable.

The normal duration of the Service is 12 (twelve) months from the date of purchase, unless Ceramica Vietrese don’t decide to close the free services without notice.
3.3 NATURE OF SERVICES - FEES AND PAYMENT WHEN YOU OPEN THE SERVICE
The nature and the type of the Services given by Ceramica Vietrese to the Users is described into the page www.ceramicavietrese.it/createyourgiftlist.
The equivalents for the Services “Premium” and the terms and modalities of payment are these established into the page “order the gift list”.
All fees, unless specified, are inclusive of VAT.
The payment of the fees for the Service “ Premium” must be made by credit card, Pay Pall, Postepay (only for Italy) completing the module of payment during the procedure of registration. After the payment online, Ceramica Vietrese will supply to send to the address written in the module an invoice of payment.
If the payment is made with bank transfer or Postepay (only for Italy), the invoice will be send the day of the deposit on the Ceramica Vietrese bank account c/o Claudia Di Palma Via Nabucco, 20 – 80126 Napoli – Italy.
All the taxes coming from the use of the Services will be charge exclusively to the User. In case of delay in the payment, Ceramica Vietrese will have possibility of stop the Services for the effect of the art. 1460 of the Civil Code and the User must pay the default interest at the legal rate of interest increased by 5 percentage points, subject to the right of Ceramica Vietrese to compensation for greater damage. Ceramica Vietrese reserves the possibility to send invoices in electronic format to the email address provided at time of purchase. It will, therefore, exclusive user's responsibility to report to Vietri Ceramics any change to the e-mail statement.
3.4 REALIZATION OF CONTRIBUTIONS

The Guest could pay is quote using various method of payment Bank Transfer, Credit Card, Paypall, Postepay (only for Italy), following the process on the website. Ceramica Vietrese will take care of sending an e-mail to Users and Guests, to notify their correct gift registration to the e-mail address given.

User will receive an e-mail of notify every time that a Guest will realize a quote in his gift list.

A contributed to be paid will be identified in the party people panel control, into the section “Received Gift” as “waiting to be paid” and it don’t give right to transfer. For the fight against the fraud and the money laundering, the payments with credit card will have a verification period of 10 working days. During this period, the gift will be signed in the panel control as “waiting to be verified” and user couldn’t have the collect funds without the respect of the timing indicated.

In case of a fictitious contribution (ex. Annulled operation with credit card) or the payment won’t be ended (a Bank transfer don’t received from Ceramica Vietrese) Ceramica Vietrese will inform the user and will annul the operation. In case of suspect of fraud, Ceramica Vietrese have the right to cancel or block a contribute or the completely wedding list, giving back the received contributes to the guests, according with D. M. July, 5 2012 of Ministry of Economy and Finance.

Guest have a period for 14 days from the date of the payment to reclaim a refund. To have it, he must send an e-mail to info@ceramicavietrese.it or a telegram ( the letter must be send to Ceramica Vietrese c/o Claudia Di Palma Via Nabucco, 20 – 80126 Napoli – Italy). The bank charges for the refund will be write off from the refunded amount. If beneficiaries have already demanded the amount paid, the refund won’t be allowed.
3.5 USE OG GRANTS RECEIVED

Beneficiary must provide to Ceramica Vietrese the documents specified to complete the activation of their gift list and have the possibility to receive their selected product.
3.6 ANTI-FRAUD AND MONEY LAUNDERING MEASURES

Ceramica Vietrese have an anti-fraud system, that use with automatic and manual controls on every transaction on the website. If an advice is active, Ceramica Vietrese have the right to demand information to beneficiary and users.

In case of suspect of fraud Ceramica Vietrese have the right to block a payment or a gift list completely until to the situation will be clarify. In case of doubts or if one of the parts don’t want to collaborate, Ceramica Vietrese will be obligated to close the gift list and it haven’t any responsibilities.

DECLARATION AND RESPONSIBILITIES OF THE CUSTOMERS
4.1 All the users, without exceptions

The Users are obligated to use the service in compliance to the General conditions of use and to the present CP, to the Law, to the morality, to the customs generally accepted and the public order, respecting religions and all the rules in the fight against the racism and discrimination.

The Users are obligated to not publish in their website offensive content or that do not respect the laws in force.

The users give up to retain Ceramica Vietrese responsible for what concerns the contents of the site to which they connect.
4.2 The Users.

The Users declare to be adult and to have the necessary legal capacity to contract the services offered by Ceramica Vietrese.

The Users must register themselves to the website, read and accept present conditions before to use the Service. With the acceptance, the Users:
a. they guarantee the veracity of the information provided on the identity, the e-mail address and postal address entered on the form for registration;
b. declare themselves responsible of the authenticity of the event and the truth of the information given on the website, and they guarantee that the contents published respect the laws in force and the dignity of the people;
c. Ceramica Vietrese isn’t responsible of the intellectual property rights that could generate the loaded contain (tests, descriptions, photos of the gift ideas loaded in the wedding list) and their
truth.

Users abandoning their take legal action against Vietri Ceramics, with the aim to defend their image, intellectual property and data published in their personal page; they agree to publication of their site in the search engines, unless otherwise specified in their site's privacy settings.

The users waive summon Ceramica Vietrese as an intermediary if conflicts arise concerning the content posted in their personal page.

The Users are agreed to give back to the Contributor the amount given in case of fraudulent activity. Ceramica Vietrese will give back the amount of the contribute by scaling from the amount of the contributes received from the users’ payments on own gift list. In case of there aren’t money or the capital will be inferior to the amount of the contributor, Ceramica Vietrese could ask to the Users a bank transfer for the amount.

GUESTS

Guest accept present Particular Conditions for all the things considering the realization of the contributes. With the acceptance:
a. he guarantee the truth of the information about his identity, e-mail address and his postal address inserted during the realization of the contribute and he allows that these information are
transferred to User.
b. he declare to be responsible to effect the contribute in the gift list, and he exempt Ceramica Vietrese from any mistakes for the identification of the gift list relative to event.
c. he declare himself responsible of the truth of information inserted in the website of the gift and he guarantee that the published content in the same site respect the applicable laws and
the dignity of the person. Contributors could use graphic material or texts if they have the correspondent right to use, and they are obliged to not use the service outside the scope of the
event.
d. he accept that the realized contributes are irrevocable and that is not possible the refund, save in cases of art. 3.6 and art. 4.2.5.

LOGIN AND PASSWORD
5.1
The login credentials, e-mail address (login) and password, must be used exclusively by the user and cannot be sold to third parties. You agree to keep them secret and to ensure that no third party uses them, aware that Ceramica Vietrese is not liable for any loss, abuse or fraud.
The user guarantees that the personal information provided during the registration process to the site is complete and accurate and undertakes to Ceramica Vietrese harmless against any damages, claims for damages and / or penalties arising from and / or connected in any way breach by you of the rules on registering to the Site or on the preservation of its login credentials.

MAIL OF GUESTS AND LAW ON THE PROTECTION OF PRIVACY
6.1
The beneficiaries/users who will use the opportunity to send thank you email or personalized invitations will only enter email addresses of people from which previously have had formal authorization for the use and dissemination to third parties. The email included, in this case, on the website will be under the direct and only responsibility, of the Beneficiaries/users of the list, accepting and authorizing Ceramica Vietrese to use its data for use at the end of completion of service, raising Ceramica Vietrese of possible claims to the Privacy Act.
Any dispute regarding the use of the lists on the site www.ceramicavietrese.it will be governed by Italian law and jurisdiction will be the Naples Bar
